DA Drops Charges Against Florentino Lopez Jr. After Video of Santa Ana Officers Punching Him; City Orders Independent Probe
The Orange County District Attorney has dropped criminal charges against Florentino Lopez Jr. following viral video of Santa Ana officers punching him during his Oct. 1, 2026 arrest; the City Council's independent investigation is underway and will determine whether the DA reviews the officers' conduct.
Florentino Lopez Jr., 28, is the subject of the arrest. Officers identified by his attorney as Luis Casillas and Marco Benavides are named in the complaint. The OCDA, Santa Ana City Council, SAPD Chief Robert Rodriguez, and the police union are the key institutional actors.
Bystander video of Lopez being thrown to the ground and punched during a Santa Ana police arrest went viral, prompting the City Council to order an independent use-of-force investigation; the DA subsequently dropped criminal charges against Lopez and is deferring any decision on the officers pending the probe.
Santa Ana, Orange County, California — OC's only declared sanctuary city.
The arrest occurred Oct. 1, 2026. Video circulated Oct. 6. The City Council voted Oct. 7. The DA dropped charges Oct. 13. Lopez gave his first interview Oct. 15. The independent investigation is ongoing.
The video prompted widespread public concern about the officers' use of force during the arrest. The DA concluded it could not proceed with the criminal case against Lopez while scrutiny of the officers' conduct is unresolved.
As of Oct. 17, 2026, the criminal case against Florentino Lopez Jr. has been dropped by the Orange County District Attorney, and the Santa Ana City Council's ordered independent investigation into the officers' use of force is underway. The DA has made no decision on the conduct of the officers involved and is waiting on the city probe before doing so. No new material developments have emerged since Oct. 16.
Bystander video of the Oct. 1 arrest showed officers throwing Lopez, 28, to the ground and punching him. The video circulated widely by Oct. 6, prompting the city to act. The Santa Ana City Council voted unanimously on Oct. 7 to hire an outside investigator and to release officer names and body-worn camera footage if great bodily injury is legally determined.
Lopez had been charged with felony and misdemeanor resisting an officer, misdemeanor smoking marijuana near a school or daycare, and an infraction for walking outside a crosswalk. He pleaded not guilty. The criminal complaint lists officers with the last names Casillas and Benavides; Lopez's attorney, John Kremer, identified them as Luis Casillas and Marco Benavides. OCDA spokeswoman Kimberly Edds confirmed the case was dropped Oct. 13 and that the office will pursue a probation violation instead; Lopez's bond was exonerated and he is out of custody. A probation-violation hearing is expected in December 2026, according to KFI, though no exact date has been published.
In his first interview, given Oct. 15 to Voice of OC and The Santanero, Lopez said he had stepped outside his father's landscaping job to smoke when an officer he knew called him over; he said he complied, an argument followed, and officers bent him over the hood while relatives recorded. He said he was kneed, was not allowed a phone call, and declined medical attention. He said the body-camera video will show he cooperated.
Santa Ana Police Officers Association president John Kachirisky deferred questions to the department and said the union's concern is a fair investigation, adding that officials who appear to have made up their minds raise concern the probe will be one-sided. Chief Robert Rodriguez and the city did not answer questions about who will run the outside investigation or what it will cost.
The city's independent investigation is the central pending action. Its findings will determine whether the DA reviews the officers' conduct, and whether officer names and body-camera video are publicly released. No timeline for the outside investigator's report has been publicly announced. A probation-violation hearing for Lopez is expected in December 2026.
