The measure — backed by the Newport Beach Stewardship Association (NBSA), SPON and the Coalition for Responsible Housing, and championed by former mayor Marshall Duffield — would replace the city's state-certified housing plan (which zones for more than 8,000 new homes) with one zoning for roughly 2,900, according to Voice of OC and LAist.

The city's theory, per Voice of OC, is procedural: proponents allegedly did not properly publish and post public notice before circulating the petition, and the city argues the initiative is "beyond the power of the electorate to adopt." City officials stress the suit is "not about the merits" of the measure but about whether legal requirements were met.
