The Dana Point Harbor renovation is in a holding pattern following a second consecutive board failure. As of the last recorded board action on Aug. 25, 2026, the Orange County Board of Supervisors deadlocked 2-2-1 on the lease bifurcation agreements that would have unlocked construction of two new hotels at the county-owned harbor. No subsequent board action has been reported.

Supervisors Foley and Sarmiento voted to approve the new ground leases; Chaffee and Wagner voted against; Nguyen abstained. The deadlock follows a 4-1 vote on Aug. 11 that continued the item rather than deciding it, with Foley the lone dissenter on that procedural vote. The central sticking point in both instances has been worker-protection provisions for employees at the Marina Inn and Wind & Sea restaurant — the latter is reported to be closing around Sept. 15, affecting approximately 198 workers.

Developer Bob Olson of Dana Point Harbor Partners told Voice of OC that without the lease bifurcation the partnership is forced to remodel the existing hotel footprint rather than build two new properties, and stated he does not plan to return to the board "anytime in the near future." Coverage now describes the project's private-investment scope as approximately $700 million, up from prior $600 million figures.

The harbor is county-owned property. The bifurcated ground-lease structure was designed to allow two hotel pads to be developed under separate long-term (66-year) leases — the mechanism that would make lender financing viable for the hotel component. Without board approval, that financing path closes. Hundreds of millions in projected city and county revenue remain in limbo, along with the broader retail, dining, and marine-services renovation that Dana Point Harbor Partners has been advancing under the existing public-private partnership.

No future board hearing date has been publicly announced based on available evidence. The Aug. 26 Voice of OC report characterized the negotiations as having been conducted with limited public transparency. The fate of the hotel component now depends on whether any supervisor moves to reschedule the item, or whether a political resolution on worker protections can be brokered outside of the formal hearing process.
